For the purposes of this Privacy Policy, the term “Services” refers collectively to (i) our website located at (the “Site”); (ii) any of our mobile games or applications made available on various platforms (the “Games”).

This Privacy Policy sets forth the core principles governing our data practices and provides you with essential information about the types of personal data we may collect, the purposes for which we process such data, and the rights and choices available to you under applicable data protection laws.

By accessing or using any of our Services, you acknowledge that you have read and understood this Privacy Policy, and you agree to the collection and use of your information in accordance with its terms.

We will not use or share your information with anyone except as described in this Privacy Policy. We are committed to protecting the privacy and security of all personal data processed as part of our business activities.

Our legitimate interests are: maintaining and managing the Services, providing the Services to you, improving the Services, processing of the information that you choose to provide to us via email or submitting on our Site or by using the Services, preventing fraud or harm to us or to any third party, ensuring the overall security of our network and services, compliance with any contractual, legal or regulatory obligations under any applicable law.

2. HOW WE COLLECT YOUR PERSONAL DATA

We may collect information about you by the following means:

(i) Directly from you, when you provide information to us or interact with us;

(ii) Through use of cookies and other similar tracking technologies;

(iii) From online advertising companies who may share information about the marketing and advertisements you have seen or clicked on, and from social networks and other sources of publicly available data;

(iv) From other third party sources (for example, service providers who provide consumer data, such as information about your interests and marketing inferences, sub-contractors in technical, payment and delivery services, analytics and tracking software providers).

3. PERSONAL DATA WE COLLECT AND HOW WE USE THE PERSONAL DATA

(i) Usage Details about your interaction with our Site (such as the pages visited, links clicked, referring URL, searches performed on our website and other similar information related to how you have used our Site);

(ii) Device Information including the IP address and other details of a device that you use to connect with our Services (such as browser type, operating system, device type and other similar technical information typically received from a browser or device automatically);

(iii) Location information we use publicly available sources to approximate your geographic region and Internet Service Provider based on your IP address;

(iv) Contact information and any other information you choose to include when you communicate with us via email, mail, phone or other channels;

(v)Profile and subscription information, such as a username and password, your full name, mailing address, phone, e-mail address or subscription preferences, when you create an account to use the Services or register with us using your existing social media account details, like your Facebook or other social media account;

(vi) Biographical information when you inquire about or apply for a position with us;

(vii) Transactional and payment information is not collected or processed by us directly. Any purchases made within our Games (such as subscriptions or virtual items) are processed by third-party platforms (e.g., Google Play, Apple App Store, Amazon Store). These platforms may collect payment-related information subject to their own privacy policies. We recommend reviewing their respective privacy notices for more details.

We do not process sensitive or special categories of information.

PURPOSE OF PROCESSING

(i) to manage and administer the Service provided to you;

(ii) to inform you of any updates to the Services, including new features and functionalities;

(iii) to tailor the content that we may send or display to you and to otherwise personalize your experiences while using our Services;

(iv) to improve the Services of Mamboo, partners and affiliates (including targeted advertising and modelling Internet user behavior) and for other research, analytical or statistical purposes;

(v) to communicate with you, including via email, about our Services; to respond to your inquiries or complaints;

(vi) to prevent fraud or harm to us or to any third-party, and ensure the security of our Services;

(vii) where it is necessary for Mamboo to comply with its legal obligations and to exercise and enforce its legal rights;

(viii) to deliver and target advertising and marketing and promotional information to you.

Lawful Basis for Processing:

Mamboo will only collect and use your personal data when the law allows us to. There are different lawful bases for us to collect and use information, depending on the laws that apply to you based on where you live and use Mamboo Services from. The most common lawful bases that we rely on to collect and use information are where:

(i) You have given us your consent;

(ii) It is necessary to fulfil our contractual obligations to you;

(iii) It is necessary for our or a third party's legitimate interest that is not overridden by your fundamental rights; or

(iv) It is necessary to comply with a legal or regulatory obligation.

Some of this personal data is collected through cookies and other tracking technologies, which may be operated by our partners who assist us in serving ads or providing other services to you.

You may be able to opt out tracking by cookies or control how information collected by cookies is used via a number of means, as described in Section 10 “COOKIES, OTHER TRACKING TECHNOLOGIES AND HOW TO MANAGE THEM”.

4. PERSONAL DATA SHARING

We do not sell your personal data. However, in order to operate, provide, and improve our Services, we may share your information with third parties under the circumstances described below, in accordance with applicable data protection laws. We ensure that any such disclosure is limited to what is necessary and is subject to appropriate safeguards and data protection agreements, where required by law.

(i) (a) Advertising Partners: companies that enable us to monetize the advertising inventory within our Games and, in doing so, provide users with access to free products and services. These partners typically collect data through their proprietary technologies, such as SDKs. (b) Analytics Providers: companies that supply us with tools and technologies designed to help us better understand user engagement with our Services, thereby assisting us in enhancing and optimizing user experience. These providers also generally collect data through their own SDKs. A list of our analytics partners and access to their privacy policies can be found at: link.

Where required by applicable law (such as in the European Economic Area), we only share such information with third parties for advertising and analytics purposes based on your prior consent, which you may provide or withdraw via your device settings.

(ii) Third-party service providers and business partners. Mamboo engages unaffiliated third-party companies to support the operation, maintenance, and enhancement of the Services we provide. Such support may include, without limitation, assistance with payment processing, cloud and hosting services, event management, cybersecurity, and the execution of our marketing and promotional activities.

(iii) Your specified recipients. We may disclose your information to individuals or other third parties or publicly with your consent or at your direction.

(iv) When required by law, such as to comply with court orders, search warrants, regulatory orders and other lawful requests by public authorities, including to meet national security or law enforcement requirements;

(v) Legal authorities, consultants, advisors or service providers when required to investigate, respond to, or prevent, fraud; or when required to ensure the security of our Services and protect the safety of Mamboo or the public;

(vi) As part of any merger or acquisition of Mamboo, personal data may be transferred to the merging or acquiring company, as well as to any advisors representing a party during discussions of such merger or acquisition.

(vii) We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

5. HOW WE SECURE YOUR PERSONAL DATA

We implement physical, administrative, and technical safeguards designed to protect your personal data from unauthorized access, use, or disclosure. We also contractually require that our service providers protect such information from unauthorized access, use, and disclosure. In addition, we limit access to personal data to those employees, agents, contractors, and other third-parties that have a legitimate business need for such access.

6. RETENTION

Personal data that Mamboo collects and processes as a controller for the purposes identified in this Privacy Policy will not be retained for longer than is necessary to fulfill those purposes, unless a longer retention period is required or permitted by applicable law (for example, to comply with legal obligations, resolve disputes, or enforce our agreements and policies). We will retain personal data associated with a user account for a limited period following account termination, after which such data will be deleted or anonymized, unless a longer retention is legally required or justified by a legitimate business interest.

7. ​INTERNATIONAL TRANSFER

We may, directly or indirectly through trusted third-party entities around the world, process, store, and transfer the information you provide, including your personal data, as described in this Privacy Policy. This may include transfers to countries outside your jurisdiction, including countries outside the European Economic Area (EEA, including the European Union), the United Kingdom, and Switzerland, including countries that may not offer the same level of data protection as your home jurisdiction and are not subject to an adequacy decision by the relevant authorities. Your personal data may also be accessed or processed by personnel or service providers operating outside of your jurisdiction who work for us or on our behalf, solely for the purposes set out in this Privacy Policy. Mamboo is headquartered in the United Arab Emirates and operates globally. To ensure an adequate level of protection for your personal data, we have in place, or will implement where required, appropriate contractual safeguards, including data processing agreements with our partners and service providers. For transfers from the EEA, the United Kingdom, or Switzerland, we rely on approved legal mechanisms such as the European Commission’s Standard Contractual Clauses (SCCs), the UK International Data Transfer Agreement (IDTA) or Addendum, and other legally recognized safeguards under applicable law. In addition, for users located in the United States, including California and other states with applicable data privacy laws, we comply with relevant state-level data protection regulations when transferring personal data outside the United States. We take commercially reasonable steps to ensure that such transfers are subject to appropriate safeguards in accordance with U.S. state privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and other applicable legislation.

We take all reasonable steps to ensure that all international transfers of personal data are carried out in compliance with applicable data protection laws and that your privacy rights remain protected, regardless of where your personal data is processed.

8. YOUR PRIVACY RIGHTS AND CHOICES

8.1. Our use of cookies and other tracking technologies. We provide you with various options regarding how we may use your personal data in connection with cookies and other tracking technologies, including, but not limited to, web beacons, SDKs, device identifiers, and similar technologies. These technologies may be used across our Site, as well as within our Games. They are utilized to serve interest-based advertisements, analyze your interactions with our Services, improve performance and functionality, and personalize your user experience. You may manage your preferences relating to our use of cookies and other tracking technologies, including their use for targeted advertising and analytics, by following the instructions provided in Section 10 “COOKIES, OTHER TRACKING TECHNOLOGIES AND HOW TO MANAGE THEM.”

8.2. Updating your data. You may request that we correct or update any inaccurate or incomplete personal data by contacting info@mamboogames.com. You may, of course, decline to submit personally identifiable data through the Services, in which case Mamboo may not be able to provide certain services to you.

8.3. Asking a copy of your data, withdrawing your consent. You can contact us at info@mamboogames.com at any time to request a copy of your data or to withdraw your consent. Please note that withdrawing your consent will not affect the lawfulness of processing based on consent before its withdrawal. However, certain features or services may no longer be available to you if they rely on the data processing that you withdraw your consent for.

8.4. Requesting data deletion: If you wish to request the deletion of your personal data that we have collected, you can do so by following these steps:

Email Request: Send an email to info@mamboogames.com with the subject line “Personal Data Deletion Request”. In the email, please include your full name, contact information, and details of the data you wish to have deleted.

Verification: To protect your privacy and security, we may need to verify your identity before processing your request. We will contact you to provide additional information if needed to complete the verification process.

Processing Time: Once your request is verified, we will process it as soon as possible in compliance with our policies.

Notification: We will notify if there are any reasons we are unable to comply with your request.

Jurisdiction-Specific Notices.

Certain jurisdictions may provide individuals with additional rights regarding the collection and use of their personal data. Where we are using your personal data because it is in our legitimate interests to do so, you can object to us using it this way. Where we are using your personal data for direct marketing, you have an absolute right to ask us to stop doing so;

(viii) Rights with respect to automated decision-making and profiling. You have the right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you;

(ix) Right to withdraw consent. Where we are using your personal data based on your consent, you can withdraw your consent at any time;

(x) Right to lodge a complaint with the appropriate data protection authority. You have the right to bring a claim before your competent data protection authority. However, before doing so let us know first at info@mamboogames.com. We care about your privacy and want to make sure that we do everything to address any of your concerns.

To submit a request to exercise your rights, please request via email to info@mamboogames.com. We may have a reason under the law why we do not have to comply with your request, or may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

8.5.2. US states

California

The California Consumer Privacy Act (“CCPA”), along with the California Privacy Rights Act amendment (“CPRA”), provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of information about them, as well as rights to know/access, delete, and limit sharing of Personal Data. You have the right to be free from discrimination based on your exercise of your CCPA rights.

We do not “Sell” (as defined in the CCPA) your personal data which we have collected or may collect and in the event we will sell your personal data, we will notify you by updating this Privacy Policy and we will provide you with the option of opting out of such “sale”.

We may, however, use your personal data for “sharing” as defined under the CPRA for purposes of cross-context behavioral advertising, and you have the right to opt out of such sharing.

Privacy Rights for Californians:

Under the CCPA, California residents have specific rights regarding their personal data. This section describes Californians' rights and explains how California residents can exercise those rights.

Below we further outline specific rights which California residents may have under the CCPA.

(i) Right to access your data. You have the right to request that we disclose certain information to you about our collection, use and disclosure of your personal data over the past twelve (12) months. Any disclosures we provide will only cover the 12- month period preceding the receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable;

(ii) Right to data portability. You have the right to a "portable" copy of your personal data that you have submitted to us. Generally, this means you have a right to request that we move, copy or transmit your personal data stored on our servers or information technology environment to another service provider's servers or information technology environment;

(iii) Right to delete your data. You have the right to request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal data from our records, unless an exception applies;

(iv) Right of correction. You have the right to request correction or changes of your personal data if it is found to be inaccurate or out of date;

(v) Right to non-discrimination for the exercise of your privacy rights. You have the right not to receive discriminatory treatment by us for exercising your privacy rights conferred by the CCPA.

(vi) Right to opt-out of the “sharing” of your personal data for cross-context behavioral advertising.

Upon submission of your request, we will contact you via the email address provided in your request. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to the information. In some instances, such as a request for data deletion, we may first separately confirm that you would like for us to in fact delete your personal data before acting on your request. With all requests, we will aim to complete requests as soon as reasonably practicable and consistent with any timeframes mandated by applicable laws. If we require more time, we will inform you of the reason and extension period in writing. You may authorize another individual or a business registered with the California Secretary of State, or designate an authorized agent, to make requests on your behalf through these means.

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal data for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

Complete the transaction for which we collected the personal data, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

Debug products to identify and repair errors that impair existing intended functionality;

Comply with a legal obligation; or

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Virginia

The Virginia Consumer Data Privacy Act (“VCDPA”) provides Virginia residents with certain additional privacy rights regarding the collection, use and sharing of personal data. We do not sell personal data as defined under the VCDPA. We also do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning a consumer. However, Mamboo does engage in targeted advertising, as that term is defined in the VCDPA.

Privacy Rights for Virginians:

Under the VCDPA, Virginia residents have specific rights regarding their personal data. This section describes Virginians' rights and explains how Virginia residents can exercise those rights.

(i) Right to access your data. You have the right to request that we disclose certain information to you about our collection, use and disclosure of your personal data over the past twelve (12) months. If you are a resident of Iowa, Indiana, Montana, New Jersey, New Hampshire, Nebraska, Minnesota, Tennessee, Texas, or Oregon, you have specific rights under applicable state privacy laws regarding your personal data. These rights may include the right to access, correct, delete, or restrict the processing of your personal data.

8.5.3. United Arab Emirates (UAE)
